Participation Conditions

Thank you for being part of CAFBA’s online community. To ensure the best possible experience for all members, we have established some basic guidelines for participation.

  1. Purpose

CAFBA’s purpose in providing this online forum is to give our members the opportunity to discuss matters of importance to them in building and maintaining our professionalism as commercial finance brokers.

  1. Member Commitments

When members stand behind their opinions and actions, our online forum is safer and more accountable.  To ensure this forum functions respectfully and professionally, as conditions of participation, by your participation you commit to the following conduct standards:

  • Professionalism

All posts must be respectful and professional, avoiding unlawful, misleading, discriminatory, defamatory or fraudulent comments or conduct that infringes or violates someone else's rights, including their intellectual property rights.

  • Ownership

You must post under your own name & own your comments and any content you post.

  • Platform protection

You must ensure you do not introduce, whether deliberately or accidentally, any viruses, malware or anything else that could disable, overburden or impair the platform’s functionality.

  • Confidentiality

This is a closed membership group so posts must not be shared outside the platform in any way at all.

  • Intellectual property

You must not present and/or share articles or other content without attribution and/or permission.

  • Discussion Content

Discussion on the platform is limited to CAFBA professional development matters, such as:

  • CAFBA governance - policies/professional standards/constitution/membership criteria/future initiatives etc
  • CAFBA training - requirements/issues/service provision etc
  • Government – policy/regulatory developments etc
  • Broker Casework – specific commercial client requirements/challenges in scenario format only
    • no client, business and/or financier must be identifiable through the post

 

  • Prohibited Content

Members may not make comments or post content on matters such as:

  • Financier/Lessor/Insurer products, policies and/or procedures
    • Concerns about these matters should be raised directly with the relevant provider
  • The regulatory environment & risk and compliance obligations
    • These are matters for your own legal advice
  • Employment terms and conditions, including remuneration matters
    • These are matters for advice between your employer and you
  • Broking business & employment opportunities
    • This forum is a professional development forum, not an employment marketplace
  • Business promotions of any kind
    • CAFBA promotions are the only exception
  • Regulator enforcement actions against broker businesses & individuals
    • These are matters subject to legal processes

 

If you are uncertain about whether a specific matter can be raised in our discussion forum, please contact the moderator for guidance before posting.

  1. CAFBA Commitments

In providing this forum, CAFBA commits to providing you with a safe, closed user group with high professional standards.

  • Platform security

CAFBA requires the platform service provider to take reasonable efforts to secure the information you choose to provide and to use a variety of security technologies and procedures to help protect against unauthorised access to or alteration, disclosure, or destruction of your personal data and content.

 

Access to your personal data is limited to our employees, contractors and service providers who need to know the information in order to operate, develop, or improve this member service.

 

  • Your Data

We retain your personal data for as long as your membership account is active or as needed to provide you with this member service, to comply with our legal obligations and to resolve disputes and defend any potential legal action arising from how you use this forum.  

 

Also, CAFBA will manage your personal information in accordance with its privacy policy.

 

  • Moderation

All posts and other content will be moderated before being posted to the forum to ensure they meet these participation conditions.  Consequently, there will be a delay between when you submit a post and it be published in the forum.

 

Where the moderator has concerns about the nature of your post, you will be contacted to discuss the reasons why and to discuss how best to modify, if possible, the post to ensure it meets CAFBA’s requirements.

 

  • Suspension/Termination

If the moderator determines you have clearly, seriously or repeatedly breached these participation conditions, CAFBA may suspend or permanently disable access to your account.

 

We may also suspend or disable your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons.

 

Where we take such action, we will let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability, harm other members, compromise or interfere with the integrity or operation of this forum, or where we are restricted due to technical limitations or prohibited from doing so for legal reasons.

 

We will use a ‘3 strike’ rule to deal with repeated breaches of the participation conditions:

  • First Breach
    • A written notice will be sent to you, setting out the basis for the breach
  • Second Breach
    • You will receive a written notice setting out the basis for the breach
    • Your access will be suspended for 30 days
    • A CAFBA staff member will call you to discuss the community guidelines
  • Third Breach
    • You will receive a written notice setting out the basis for the breach
    • Your access will be suspended for 60 days
    • A CAFBA staff member will call you to discuss the community guidelines

 

  • Dispute Resolution

Should you disagree with any action CAFBA takes to limit your participation in this forum, you can lodge your complaint online through ceo@cafba.com.au 

 

Also, if you have concerns with the content of a posting made by another person on this forum, you can lodge your complaint online through ceo@cafba.com.au

 

CAFBA’s Chief Executive Officer (CEO) will review your complaint and decide how best to resolve the dispute.

 

  1. Liability Limits

By participating in this online forum, you agree you have read and will follow these participation conditions and any subsequent conditions or protocols CAFBA develops.

You acknowledge you are responsible for any content you post and any consequences of those posts, including any legal action that may result.

To the extent allowed by law, CAFBA is not responsible for the opinions and content you post, or anyone else posts, on this platform.
